1. Scope and contracting parties

These Terms govern access to and use of the FuzeWork mobile and web service. FuzeWork is a work tool for attendance, projects, teams, photo documentation, quality issues, receipts and related operational records.

The agreement is between the FuzeWork operator identified in section 15 and the person or organisation using the service. Where a company creates the workspace, its administrator acts for that company and confirms they are authorised to do so.

2a. Minimum age of 18

FuzeWork is intended exclusively for people who are at least 18 years old. A user first self-declares adulthood, and before activating a worker the company owner separately confirms that the age check was completed. The owner is responsible for the accuracy of that confirmation. For this check, we do not require a birth date, identity document, document image, or biometric age estimate.

If we learn that an account is used by someone under 18 or that a confirmation was false, we may restrict or terminate the account or company access and delete or restrict related personal data as required by law and safety obligations. A possible future separate version for younger users is not part of this service.

2. Accounts and access

  • Users must provide accurate information and protect their credentials.
  • Accounts are personal and must not be shared. The relevant company manages roles and project access.
  • The company must remove access when a person no longer needs the service for its work.
  • Suspected misuse or unauthorised access must be reported without undue delay.

3. Company and user roles

The company appoints administrators, team leads and workers and determines projects, attendance rules and permissions. Users may access data and functions only where they have a legitimate work-related need.

Administrators are responsible for correct company settings and for communicating internal rules. FuzeWork does not replace an employment contract, payroll, accounting, legal advice or an employer’s statutory duties.

4. Acceptable use

  • Do not use the service for unlawful monitoring, discrimination, harassment or invasion of privacy.
  • Do not bypass security, attempt unauthorised access, distribute malicious code or overload the service.
  • Uploaded content must not infringe third-party rights or include data unnecessary for the work purpose.
  • Sexual or pornographic content, threats, hate speech, bullying, violent or unlawful content, spam, fraudulent records and other conduct incompatible with a safe workplace are prohibited.
  • Photographs of people, documents and workplaces may be taken only with appropriate authority and under company rules and applicable law.
  • Do not photograph identity documents, payment cards, medical records, signatures, login credentials, security codes, private correspondence, children, people unrelated to the work, or other personal data unless this is necessary for a legitimate company purpose and permitted by law.

5. Attendance and work records

FuzeWork is a supporting record-keeping tool. The company must verify records, resolve missing or disputed attendance and retain other evidence where required by law or its process.

Times, location, photographs, comments and quality issues must not be the sole basis, without human review, for pay, penalties, termination or another decision with serious effects.

The company organisation decides on work records as their controller. FuzeWork carries out deletion on its verified instruction. Deleting a company document does not relieve the controller of its own statutory retention duties or its responsibility for the rights of people recorded in the document.

6. User content and devices

The user or company retains rights in submitted content and grants the operator only the permission needed to store, secure, back up and display it to authorised people and provide requested functions.

Camera, photo-library or location access depends on project settings, device settings and separate system permission. Users can manage device permissions in the operating system, although some functions may then be unavailable.

A user who can see content but cannot remove it may request review of an inappropriate photo or text. For another person’s content, the report may concern the content, its author, or both. For the user’s own locked content, the request concerns only the content and never creates a report against that user as author. The report creates a traceable incident with a status and recorded decision. An authorised company moderator may keep, hide or replace the content and, within their permissions, restrict the author from further commenting; moderators cannot moderate their own account or decide their own report for personal benefit.

6b. Protection of persons and serious abuse

FuzeWork must not be used for forced or involuntary labour, human trafficking, unlawful child labour, sexual or other exploitation of children, retention of identity documents, coercion, violence, or retaliation against a person who reports a concern in good faith, cooperates with a review, or exercises a right. The company remains responsible for lawful employment, age and work eligibility, and required authorisations. FuzeWork records only the 18+ confirmations described in section 2a, does not independently verify the remaining facts, and is not an investigative or emergency service.

A user may report a concern through an available reporting flow or to ombudsman@fuzenest.io. Reports should be factual and limited to necessary information. An immediate threat to life, health, or a child must be reported to the appropriate emergency service or authority; a FuzeWork report does not replace that step.

For a credible report, the operator may proportionately preserve evidence and protect the reporter, hide content, or temporarily restrict the affected account or company workspace. A substantiated serious or repeated violation may lead to user deactivation, suspension or termination of the whole company workspace, and cooperation with a competent authority where the law requires it. AI does not impose these measures: an authorised person decides, an audit record is kept, and unless safety or law prevents it, the affected person receives a reason and a chance to respond or seek review. A report is not by itself proof of wrongdoing, and FuzeWork does not promise to automatically forward every report to police.

6a. Preventive content checks and moderation

To let users share text and photographs lawfully and safely, and to comply with Google Play and Apple App Store distribution rules, FuzeWork applies proportionate automated safety checks to supported new content. This is not discretionary surveillance and does not continuously read private communications.

Before suspicious text is submitted, the user may edit it or knowingly send it for review. A new photograph may remain hidden from ordinary galleries and exports and be replaced by a pending-check notice until the check finishes. If the network or checking service is unavailable, the check resumes after connectivity returns; the content is not ordinarily published while pending.

The automated check is advisory. A user may request human review, a moderator may not decide a matter involving their own conflict of interest, and the independent final instance is the ombudsman at ombudsman@fuzenest.io. Sexual or pornographic content, harassment, bullying and other prohibited content may lead to hiding or removal, feature restrictions, account suspension or, for serious or repeated breaches, suspension or termination of the company membership in FuzeWork.

6c. Safety checks and optional AI features

Optional AI extraction from receipts requires receipt permission, sufficient Fuzio credits, and the user’s explicit permission to send the content to Google Gemini; it is not conditional on the PRO attendance plan. Optional descriptions or tags for project and quality-report photos additionally require the relevant feature permission and an active company premium entitlement. Without permission, a receipt can be entered manually. Images without generative-AI permission receive only the mandatory Google Cloud Vision classification; no description or tags are created and they remain blocked from later optional analysis by another user.

7. Availability and service changes

The service is operated on an ongoing basis, but maintenance, security actions, network failures or third-party outages may occur. Continuous or error-free availability is not guaranteed.

Features may be changed, added or discontinued. Reasonable advance notice will be attempted for material changes unless security, law or urgent operational reasons prevent it.

8. Fees and paid features

Where paid functions are agreed, pricing, billing, limits and subscription period are governed by the order or a separate commercial offer. Taxes and payment obligations follow that offer and applicable law.

Without an express order, this section does not itself create an obligation to pay for a new service or plan.

9. Intellectual property

The software, design, marks, documentation and other FuzeWork materials belong to the operator or its licensors. Users receive a limited, non-exclusive and non-transferable right to use the service under these Terms.

The service may not be copied, sold, rented, reverse engineered or used to create derivative works except where mandatory law expressly permits it.

10. Personal data and confidentiality

Personal-data processing is described in the separate Personal Data Processing Notice. Companies and users must protect confidential information, limit access to authorised people and not reuse data for unrelated purposes.

11. Suspension and termination

Access may be suspended for a security risk, breach, unlawful use, non-payment of an agreed service or a legal requirement. Where possible, an opportunity to remedy will be given first.

The company may end use under its order. Export and deletion after termination follow the company agreement, legal duties and the Personal Data Processing Notice.

12. Liability

Each party is liable to the extent required by applicable law. The operator is not responsible for company decisions, incorrect permissions, user content, loss caused by an unsecured account or third-party services outside its reasonable control.

Nothing excludes liability that cannot lawfully be excluded or limited, or mandatory consumer rights where they apply.

13. Changes and versioning

Every published wording has a version identifier and permanent URL. The accepted version and acceptance time should be recorded with the user’s acceptance.

Material changes may require renewed acceptance. New wording does not apply retroactively unless the law expressly permits it. Archived versions remain available as evidence of earlier wording.

14. Governing law and disputes

These Terms are governed by Czech law, without removing mandatory consumer rights under the law of the consumer’s habitual residence. Disputes should first be addressed amicably; consumers may use alternative dispute resolution by the Czech Trade Inspection Authority (www.coi.cz). Court jurisdiction follows applicable mandatory law.

15. Operator and contact

Operator: Pavel Majer, a natural person, trading under the FuzeNest/FuzeWork brand. Address: Ortenovo náměstí 14, Prague 7, Czech Republic. Contact and legal-notice email: pavel.majer@fuzenest.io. No company or other registration number has been assigned; this position will be legally and tax reviewed again before regular commercial activity begins.
